2004 – U.S. Justice Department was investigating him for unlawfully mishandling classified documents by removing them from a National Archives reading room prior to testifying before the 9/11 Commission.

2005 – Convicted of unauthorized removal and retention of classified material.

2006 – On 20th of December Berger pleaded guilty and received a criminal sentence.
